Family disputes are tough on everyone involved.
Whether it is a separation or divorce, a relationship property dispute, or a dispute regarding child custody or support, we understand how stressful and emotional family disputes can be.
Emotions can intensify conflicts, often to the detriment of both parties. When children or significant assets are involved, the process can be especially heart-breaking, not to mention time consuming and costly. The process can become particularly difficult if the Family Court needs to be involved.
A good legal team in your corner can help you resolve family disputes promptly, cost effectively, and, if possible, without resorting to the courts. If litigation does become necessary, a good family lawyer can minimise your risk and cost, and provide the advice, advocacy, and counsel you will need to get the best result.
We at Evolution Lawyers are here to help with all family law matters. With our legal knowledge and experience with family law, advocacy, alternative dispute resolution, and litigation, our team can advise you on the best course of action for your family law matter. If you have no option but to involve the Family Court, we can represent you and fight for your interests.
Our family law services are supported by the complimentary practice areas of property law, business and commercial, and trusts and estates. This means we can assist you with all legal matters arising from your divorce, separation, or other family law matter.
This may include, for example, preparing new wills and enduring powers of attorney, establishing new trusts or dissolving a previous one, conveyancing, and business structuring advice. Such matters are usually outside the scope of a traditional family law barrister.
Our compassionate and approachable family lawyers provide a safe environment to deal with your matter in a way that you feel comfortable. We understand the importance of clear and consistent communication to provide peace of mind. Our team will keep you informed throughout the process and aim to resolve the dispute quickly, so everyone can move on with their lives.
If you are thinking about separating from your partner, are worried about child custody, or just want to know your rights about a family dispute or other family law matter, contact us today to speak to one of our family lawyers.
If you are thinking about moving in with your partner or are already living together, it is common to enter into a contracting-out agreement under the Property (Relationships) Act 1976. A contracting-out agreement is sometimes known as a relationship property agreement or ‘pre-nup’, which is short for pre-nuptial agreement. For more information, please see our article on Contracting Out Agreements.
You will need a family lawyer to assist with drafting your contracting-out agreements. You should seriously consider a contracting-out agreement if you own a house, have a KiwiSaver fund, are a beneficiary of a family trust or likely to inherit money, are getting married or in a civil union, or have assets that you want to protect from the equal sharing presumption that applies on separation.
Typically, separating with a valid contracting-out agreement is less painful and cheaper than separating and negotiating the division of relationship property without one.
If separation or divorce is your only option, our family law team is here to help with dividing your relationship property.
Separating from a spouse or partner is one of the hardest things a person may experience during their life. Often emotions are running wild and things can get complicated quickly.
Every client’s situation is different. If you have a family home, a family trust, or a family business, you will need a family lawyer to document and facilitate the legal aspects of dividing relationship property. Your lawyer can also advise on, and represent you, to negotiate terms for the separation.
If you have children, you will need to arrange for their care and well-being during the separation process. We can help make that part of the separation process as smooth and as painless as possible.
If you are in the process of separating from your spouse or partner or thinking about doing so, please contact our family lawyers to assist in the separation process and dividing your relationship property.
If you want to divorce your ex-spouse or partner, our family law team can help you apply to the court for a dissolution order (also known as a divorce) dissolving your marriage or civil union.
You can apply for a dissolution order after two years of living separate and apart. You can apply for a divorce even if your ex-partner refuses to consent. We are here to assist with your court application.

Parenting through a separation is challenging.
If you and your ex-partner or spouse have an arrangement for the care of your children, you should document that arrangement in a parenting agreement. A parenting agreement provides guidance, but it is not legally enforceable without a Family Court order.
We can assist with negotiating and documenting the terms of a parenting agreement.
If you would like your parenting agreement to be legally enforceable, we can assist in applying for a parenting order in the Family Court.
Caring for children during or after a separation can be tricky and financially difficult. Receiving or making child support payments can be done in three ways;
If you need assistance in getting child support, we can advise you on your rights and help you get the financial support you require to care for your children.
Mediation can be an effective way to resolve a family dispute. We are happy to discuss the possibility of a mediation and help you find a fair and reasonable solution for all parties involved without having to go to Family Court.

Thank you Sheryl Waru2024-04-22 My experience with Evolution Lawyers, especially working alongside Tamina and her team, has been nothing short of exceptional. What sets them apart is their genuine commitment to incorporating kaupapa Māori values and principles into their legal practice, creating a supportive and culturally sensitive environment for their clients. From the outset, I was impressed by her deep respect for tikanga Māori and her willingness to integrate it into every aspect of my legal proceedings. Tamina and her team took the time to understand my cultural perspective and ensured that my voice was heard throughout the process. Their approach was not only legally sound but also culturally responsive, which made me feel valued and understood as a Māori client. Nga mihi nui e hoa, nga manaakitanga. Sheryl Alwyn Hamblyn2024-04-11 Tamina from Evolution Lawyers deserves so much more than 5 stars! With the sensitive nature of the case that Tamina assisted with, we can't thank her enough. She was so professional and efficient in all aspects of the case. Her communication was excellent, and when she believes in you, she definitely fights in your corner! Highly recommend Tamina, and her team. Greg Heap2024-01-18 Professional and friendly service once again from Evolution Lawyers. We had an unfortunate family disagreement about our 3 party joint property ownership, with one party insisting on immediate sale and threatening court action via their lawyer. We shared a joint mortgage as well. Two of the three parties didn't want to sell with the market conditions being poor and a sale would have been at a big loss. After talking withThomas (Managing Director) and Favour (Solicitor), and expressing our worries about not wanting to sell our home, the joint mortgage, finances and the disagreement with the other party, and the stress we were feeling Thomas got out an old fashioned white board and came up with a plan. Then over the next two months Favour put that plan into action. It involved us collating years of financial information; working with our broker (who was contacted by Favour) to obtain a new home loan which was a feat in itself given that we are an older couple; communication with the other party's lawyer and working out and getting signed a Deed of Settlement before we could progress to the actual Title Transfer and agreement between the 3 parties to move the property from three owners to two. We are amazed at the way this complex situation was able to be resolved by the hard work (including a big rush pre-Christmas to get it sorted) and professional expertise of the team at Evolution Lawyers; Thomas, Favour, Georgia, and Sophie all assisted us on this occasion. Thank You. Kylie Stafford2023-11-08 We can't speak highly enough of Tamina and the Evolution Lawyers team. Purchasing a property is stressful and when you throw a few curveballs into the mix you need a slick team in your corner to navigate the obstacles and set a clear path. That's exactly what they did for us, minimising the pain, keeping us safe and communicating in language we could understand at every step. Thank you all from the bottom of our hearts. You all helped our little whanau dream come true with care and aroha. Kylie & Jo. Paul Hoskin2023-10-11 I have nothing but positive things to say about the service, care, and expertise of the team. Service delivery was fast and accurate and being in a different country didn't make a difference because the use of technology is in their DNA. The cost was super reasonable. I highly recommend the company.Load more
